顧客因“大盤雞放土豆”報(bào)警？民警回應(yīng)

大盤雞是不少人都喜愛(ài)的大眾美食，近日，上海市公安局寶山分局楊行派出所的90后社區(qū)民警陳嘉文，因?yàn)橐淮侮P(guān)于“大盤雞里該不該放土豆”的調(diào)解意外火了。

A Shanghai police officer has won praise online after calmly resolving an unusual dispute over whether potatoes belong in Xinjiang's signature dish dapanji, or big plate chicken.

事情的起因說(shuō)起來(lái)也很出人意料：

一名顧客在餐館點(diǎn)了份大盤雞，上菜后發(fā)現(xiàn)大盤雞里有土豆，而他認(rèn)為正宗大盤雞里絕不該放土豆。而且，店里另一道土豆燒雞塊僅售38元，“加了土豆的大盤雞”卻要68元。

整整30元的差價(jià)，報(bào)警人覺(jué)得這屬于“欺詐”行為，直接撥了報(bào)警電話。

The incident began when a customer ordered the popular dish at a restaurant but complained after finding potatoes in it, insisting that an authentic version should not include them. Pointing to a cheaper chicken-and-potato dish on the menu, the customer believed the price difference amounted to fraud and called the police.

接警趕到現(xiàn)場(chǎng)的，便是上海市公安局寶山分局楊行派出所的民警陳嘉文。面對(duì)情緒激動(dòng)的報(bào)警人，他先安撫對(duì)方的情緒。等對(duì)方平復(fù)些，再結(jié)合法律定義逐條解釋：

法律上的欺詐是虛構(gòu)事實(shí)、隱瞞真相來(lái)謀取不當(dāng)利益。

但大盤雞放不放土豆，沒(méi)有法定的統(tǒng)一標(biāo)準(zhǔn)，每家店都有自己的配方做法，這屬于店家的口味特色，算不上“虛構(gòu)事實(shí)”。

此外，菜單明碼標(biāo)價(jià)掛在顯眼處，下單屬于自主消費(fèi)行為，不構(gòu)成“欺詐”。

法理講完，陳嘉文又順勢(shì)遞上情緒的臺(tái)階：“我懂你的感受，期待的菜端上來(lái)不符合預(yù)期，換誰(shuí)心里都不痛快。如果你對(duì)這道菜還是不認(rèn)可，我可以當(dāng)溝通橋梁，跟老板再協(xié)商。如果你對(duì)結(jié)果依然不認(rèn)可，也可以之后通過(guò)12315消費(fèi)者熱線維權(quán)。”

一旁的老板見(jiàn)狀也主動(dòng)退了一步，愿意免收這道大盤雞的錢。

雙方各退一步，報(bào)警人也同意了調(diào)解方案。

Chen Jiawen, a community police officer from Yanghang Police Station in Shanghai's Baoshan district, explained that recipes vary by restaurant and there is no legal standard defining whether the dish should contain potatoes. He also noted that the menu clearly displayed the prices, meaning the case did not constitute fraud.

Chen then offered to help mediate with the restaurant owner and informed the customer that consumer rights complaints could also be filed through the consumer hotline 12315. The owner agreed to waive the charge for the dish, and the customer accepted the settlement.

最后報(bào)警人還是把整盤大盤雞都吃完了，臨走還特意跟陳嘉文念叨：“你可得跟老板說(shuō)說(shuō)，讓他去新疆調(diào)研一下，正宗大盤雞哪有放土豆的！”

這場(chǎng)因土豆而起的糾紛，只是陳嘉文日常處置的諸多警情里的一個(gè)小小縮影。

陳嘉文坦言，每一通報(bào)警都必須認(rèn)真對(duì)待，是因?yàn)椴荒芘懦硪环N可能：“有時(shí)報(bào)警人可能身處危險(xiǎn)場(chǎng)景，不便直接明說(shuō)，會(huì)用這類不尋常的描述暗示我們。所以我們必須趕到現(xiàn)場(chǎng)查證，絕不能漏掉任何一次潛在的險(xiǎn)情。”

Chen later said every police report must be taken seriously because unusual complaints can sometimes conceal real emergencies.
